These Terms & Conditions (the “Terms”) govern your access to and use of Discere Orare (the “Service”), a Catholic Latin learning app operated by Kasey Devine, an individual sole proprietor (“we,” “us,” or “our”). By using the Service you are entering into an agreement with Kasey Devine.
1. Acceptance
By creating an account, signing in, or otherwise continuing to use the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. You must be of legal age in your country, or have permission from a parent or legal guardian, to use the Service.
2. The Service
Discere Orare is an interactive course that teaches the prayers of the Catholic Church in ecclesiastical Latin — the Sign of the Cross, the Pater Noster, the Ave Maria, the Creeds, the prayers of the Latin Mass, and related vocabulary. The Service is provided through a web application and may include audio recordings, written translations, and spaced-repetition practice tools.
3. Acceptable Use
You agree not to misuse the Service. In particular, you must not:
- use the Service in violation of any law or regulation;
- engage in fraud, spam, harassment, or impersonation;
- infringe on our intellectual property rights or the rights of any third party;
- interfere with the security or integrity of the Service, including by probing, scanning, scraping, distributing malware, attempting to bypass authentication, or overwhelming our infrastructure; or
- reverse engineer, decompile, or attempt to extract the source code of the Service, except where such restrictions are prohibited by law.
4. Accounts
You sign in to the Service using a Google account. You are responsible for maintaining the security of that account and for all activity that occurs under it. You must provide accurate information and keep it up to date.
5. Intellectual Property
The Service, including its software, course content, audio recordings, translations, design, and branding, is owned by Kasey Devine and is protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial study of Catholic Latin. You may not resell, redistribute, or publicly perform the content without our written permission. The underlying liturgical texts of the Catholic Church are not owned by us.
6. Supporter Edition (Optional Digital Product)
Discere Orare is free to use. Supporter Edition is an optional, one-time, pay-what-you-want digital-product upgrade (US$1 minimum) that unlocks a stained-glass profile medallion, three accent themes, and a downloadable illuminated prayerbook PDF. Supporter Edition is not required to access any lesson, prayer, or feature; the core learning experience remains entirely free.
Supporter Edition is a software purchase, not a charitable donation. Discere Orare is a personal project, not a registered non-profit or charity; Supporter Edition is not tax-deductible.
Users who previously purchased a recurring monthly or annual support plan continue to be billed on that schedule until they cancel; new purchases are one-time only. You may cancel a legacy recurring plan at any time from your profile page or through the Paddle portal at paddle.net.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, taxes, cancellation, and refund mechanics, please refer to Paddle’s Buyer Terms.
7. Refunds
Refunds are governed by our Refund Policy.
8. No Warranty & Service Level
The Service is provided “as is” and “as available.” We do not guarantee that it will be uninterrupted, error-free, or that any defects will be corrected. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Limitation of Liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months preceding the claim, or USD $50 if you have not paid anything. We will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or devotional progress. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where such exclusion is prohibited by law.
10. Suspension & Termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts owed, present a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time. On termination, your right to use the Service ends; we may retain certain information as described in our Privacy Notice.
11. Changes
We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. Material changes will be communicated in-app or by other reasonable means.
12. Governing Law
These Terms are governed by the laws of the United States and the State of residence of Kasey Devine, without regard to conflict-of-laws principles. The courts of that jurisdiction have exclusive jurisdiction over any dispute arising out of or relating to the Service.
